OUR SERVICES

Our Services include providing recommendations and guidance surrounding the biblical principle of fasting.

Notwithstanding the foregoing, the scope of our Services may change from time to time and we reserve the right to do so in our sole discretion.

You are solely responsible for your use of the Services. Individuals who are under the age of 18 or the legal age to form a binding contract in their jurisdiction (a "Minor") are prohibited from using the Sites and the Services. Accordingly, if you are a Minor, please do not attempt to register for the Sites or send any information about yourself to us, including your name, address, telephone number, or email address.

In the event that we learn that we have collected personal information from a Minor, we will delete that information as soon as reasonably practicable. If you believe that we might have any information from or about a Minor, please contact us at hello@whenyoufast.com.

You represent that the information that you provide about yourself (including your age) as requested in any account registration form is accurate and complete.

The Services are design for your personal use. You may not open an account on the Services on behalf of a company, organization, or other entity, unless you have express permission to do so. If the need arises, we may suspend access to our Services or close them indefinitely, which may be without notice to you, although we will do what we reasonably can to notify you in advance where we reasonably do so.

USER CONDUCT

You must only use the Sites for lawful purposes, and you must not use them in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of the Sites. You may not without our prior written consent:

• Copy, reproduce, use, or otherwise deal with any content on the Sites;
• Modify, distribute, or re-post any content on the Sites for any purpose; or
• Use the content of the Sites for any commercial exploitation whatsoever.

In using the Sites, you further agree:

• Not to disrupt or interfere with the security of, or otherwise abuse, the Sites, or any services, system resources, accounts, servers, or networks connected to or accessible through the Sites or affiliated or linked website;
• Not to disrupt or interfere with any other user's enjoyment of the Sites or affiliated or linked website;
• Not to upload, post, or otherwise transmit through or on the Sites any viruses or other harmful, disruptive, or destructive files;
• Not to use, frame, or utilize framing techniques to enclose any of When You Fast’s trademark, logo, or other proprietary information (including the images found at the Sites, the content of any text, or the layout/design of any page or form contained on a page) without When You Fast’s express written consent;
• Not to use meta tags or any other "hidden text" utilizing a When You Fast’s name, trademark, or Product name without When You Fast’s express written consent;
• Not to deeplink to the Sites without When You Fast’s express written consent;
• Not to create or use a false identity on the Sites, share your account information, or allow any person besides yourself to use your account to access the Sites;
• Not to collect or store personal data about others;
• Not to attempt to obtain unauthorized access to the Sites or portions of the Sites that are restricted from general access;
• Not to post any material that is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violative of any law. You also agree not to post any copyrighted material unless the copyright is owned by you or by When You Fast; and

In addition, you agree that you will comply with all applicable local, national, and international laws and regulations that relate to your use of or activities on the Sites. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Sites. We have the right to remove any material or posting you make on the Sites if, in our opinion, such material does not comply with the content standards set out in these Terms and Conditions.

NO REFUNDS

The purchase of your membership is final. As such, once the Initial Term or any Renewal Term has started you will not be entitled to a refund.

For the avoidance of doubt, we do not offer refunds, credits or prorated fees.

PRIVACY POLICY

Users of the Sites should refer to When You Fast Privacy Policy for information about how When You Fast uses and collects information, which may be accessed by clicking on the appropriate link on the particular Site that you visited.

You agree that When You Fast may disclose your personal information to a third party if When You Fast believes in good faith that the law or legal process requires it, to protect the rights or property of When You Fast or others, or as otherwise described in the Privacy Policy.

CHANGES TO THE SITES

When You Fast may, in its sole discretion, terminate, change, modify, suspend, make improvements to, or discontinue any aspect of the Sites or any services or products available through or outside of the Sites, temporarily or permanently, including the availability of any features of the Sites or access to any parts of the Sites, at any time without notice to you, and you agree that When You Fast shall not be liable for any termination of your use of or access to the Sites.

LINKED SITES

When You Fast makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature, or reliability of sites accessible by hyperlink from the Sites, or sites linking to the Sites. The linked sites are not under the control of When You Fast, and When You Fast is not responsible for the content of any linked site or any link contained in a linked site, or any review, changes, or updates to such site. The inclusion of any link does not imply affiliation, endorsement, or adoption by When You Fast of the site or any information contained therein.

When leaving the Sites, you should be aware that When You Fast’s Terms and Conditions and policies no longer govern, and therefore you should review the applicable terms and policies, including privacy and data-gathering practices, of that site.

COPYRIGHT

All content included in the When You Fast’s Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Company or its content suppliers and protected by United States and international copyright laws.

TRADEMARKS

WHEN YOU FAST, and other graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of When You Fast in the United States and other countries. When You Fast trademarks and trade dress may not be used in connection with any product or service that does not belong to When You Fast, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits When You Fast.

All other trademarks not owned by When You Fast that appear on the Sites or as part of the Services are the property of their respective owners, who may or may not be affiliated with, connected to, endorsed or sponsored by When You Fast.

DESCRIPTIONS

When You Fast attempts to be as accurate as possible. However, When You Fast makes no warranties that the recommendations and any other content are accurate, complete, reliable, current, or error-free. If any guidance provided as part of a Service offered by When You Fast itself is not as described, your sole remedy is to submit a review of your experience to us at hello@whenyoufast.com so that we can investigate any perceived inaccuracies and errors and consider a remedy, in our absolute and sole discretion.

Please also note that the terms of any Services offered by When You Fast and/or purchased by you, such as pricing, specifications, delivery times, and/or package contents are subject to change by When You Fast by providing you advanced notice, including by posting notice of the change on our Sites or sending you an email to the address you provided at purchase. When You Fast will not incur any obligation as a result of such change. By continuing to accept Products after we have notified you of a change to any terms, you will be deemed to have accepted the change.

ORDER AND PAYMENT INFORMATION

If you use the Sites or other means to purchase a service or product, payment must be received by When You Fast prior to When You Fast acceptance of an order, unless otherwise agreed by When You Fast. When You Fast may need to verify information you provide before When You Fast accepts an order, and may cancel or limit an order any time after it has been placed. If payment has already been made and your order is cancelled or limited, When You Fast will refund any payment you made for the product that will not be shipped due to cancellation or limitation of an order in the same tender as the original purchase. When You Fast expressly conditions its acceptance of your order on your agreement to these Terms and Conditions.

In ordering Services and Products through the Sites or otherwise, you agree to provide only true, accurate, current, and complete information. You hereby certify that any email account you provide to When You Fast is registered to you. When You Fast shall have the right to bar your access to and use of the Sites or its other products or services if it has reasonable grounds to believe that you have provided untrue, inaccurate, not current, or incomplete information to When You Fast, or for any other reason it, in its sole discretion, deems appropriate. You agree that your placement of an electronic order on the Sites is sufficient to satisfy any applicable Statute of Frauds, and no further writing is required.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY AGREE THAT USE OF THE SITES, SERVICES AND PRODUCTS OF WHEN YOU FAST IS AT YOUR SOLE RISK. YOU UNDERSTAND AND AGREE THAT THE SITE, THE SERVICES AND THE INFORMATION, PRODUCTS, AND MATERIALS AVAILABLE THROUGH IT AND OTHERWISE ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.

YOU ACKNOWLEDGE THAT WHEN YOU FAST DOES NOT CONTROL IN ANY RESPECT ANY ADVERTISEMENTS, SERVICE DESCRIPTIONS, PRODUCT DESCRIPTIONS, PRODUCTS, OR CONTENT OFFERED BY THIRD PARTIES ON OR THROUGH THE SITES, INCLUDING, BUT NOT LIMITED TO, INFORMATION, SERVICES OR PRODUCTS PROVIDED BY LICENSE TO WHEN YOU FAST FROM THIRD PARTIES. EXCEPT AS OTHERWISE AGREED IN WRITING, WHEN YOU FAST AND ITS AFFILIATES ASSUME NO RESPONSIBILITY FOR AND MAKE NO WARRANTY OR REPRESENTATION AS TO THE ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY, OR USEFULNESS OF CONTENT, SERVICE OR PRODUCTS (INCLUDING DESCRIPTIONS OF SERVICES AND PRODUCTS) DISTRIBUTED OR MADE AVAILABLE BY THIRD PARTIES THROUGH OR OUTSIDE OF THE SITES. NOR DOES WHEN YOU FAST MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITES, ANY PRODUCTS OR SERVICES OFFERED OR SOLD THROUGH THE SITES, OR ITS CONTENT.

ALTHOUGH WHEN YOU FAST STRIVES TO PREVENT THE INTRODUCTION OF VIRUSES OR OTHER DESTRUCTIVE MATERIALS TO THE SITES, WHEN YOU FAST DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS THAT THE SITES ARE FREE OF DESTRUCTIVE MATERIALS. IN ADDITION, WHEN YOU FAST DOES NOT WARRANT THAT ACCESS TO THE SITES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED.

WHEN YOU FAST DISCLAIMS ANY WARRANTY OR REPRESENTATION THAT CONFIDENTIALITY OF INFORMATION TRANSMITTED THROUGH THE SITES WILL BE MAINTAINED. TO THE EXTENT ALLOWED BY LAW, WHEN YOU FAST DISCLAIMS ALL WARRANTIES AND CONDITIONS NOT EXPLICITLY STATED HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

The terms of this section survive any termination of the Terms and Conditions.

LIMITATION OF LIABILITY

WE EXCLUDE ALL REPRESENTATIONS, WARRANTIES, CONDITIONS, AND TERMS (WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR OTHERWISE) TO THE FULLEST EXTENT PERMITTED BY LAW.

IN NO EVENT, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE, SHALL WHEN YOU FAST OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES, CLAIMS, OR LOSSES INCURRED (INCLUDING WITHOUT LIMITATION COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES), HOWEVER CAUSED, AND UNDER ANY THEORY OF LIABILITY ARISING IN CONNECTION WITH: (I) THE SITES; (II) THE USE OR INABILITY TO USE THE SITES; (III) THE USE OF OR RELIANCE ON ANY CONTENT OR INFORMATION DISPLAYED IN OR ON THE SITES; (IV) THE PURCHASE OR USE OF ANY SERVICES OR PRODUCTS THROUGH THE SITES OR OTHERWISE; (V) UNAUTHORIZED ACCESS TO OR ALTERATION OR LOSS OF YOUR TRANSMISSIONS OR DATA OR OTHER INFORMATION THAT IS SENT OR RECEIVED; (VI) ERRORS, SYSTEM DOWN TIME, NETWORK OR SYSTEM OUTAGES, OR FILE CORRUPTION OR SERVICE INTERRUPTIONS; OR (VII) OTHERWISE UNDER THIS AGREEMENT/TERMS AND CONDITIONS, WHETHER OR NOT REASONABLY FORESEEABLE, EVEN IF WHEN YOU FAST OR ITS REPRESENTATIVES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, OR LOSSES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, WHEN YOU FAST’S LIABILITY TO YOU FOR ANY CAUSE OF ACTION OR CLAIM WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, BY YOU IN THE LAST 90 DAYS TO COMPANY FOR ANY SERVICES OR PRODUCTS SUPPLIED BY WHEN YOU FAST THROUGH YOUR USE OF THE SITES OR OTHERWISE.

WHEN YOU FAST WILL NOT BE LIABLE IN ANY AMOUNT FOR FAILURE TO PERFORM ANY OBLIGATION UNDER THESE TERMS AND CONDITIONS IF SUCH FAILURE IS CAUSED BY THE OCCURRENCE OF ANY UNFORESEEN CONTINGENCY BEYOND ITS REASONABLE CONTROL, INCLUDING, WITHOUT LIMITATION, INTERNET OUTAGES, COMMUNICATIONS OUTAGES, FIRE, FLOOD, OR WAR.

THESE EXCLUSIONS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAW OF THE UNITED STATES OF AMERICA. IF ANY PROVISION OF THESE DISCLAIMERS AND EXCLUSIONS SHALL BE UNLAWFUL, VOID, OR FOR ANY REASON UNENFORCEABLE THEN THAT PROVISION SHALL BE DEEMED SEVERABLE AND SHALL NOT AFFECT THE VALIDITY AND ENFORCEABILITY OF THE REMAINING PROVISIONS.

The terms of this section survive any termination of the Terms and Conditions.

INDEMNIFICATION

You agree to indemnify and hold harmless When You Fast from and against any and all claims, liabilities, losses, causes of action, judgments, settlements, damages, costs and expenses, including, but not limited to, reasonable attorneys’ fees and court costs arising from (i) your use of the Services and Product(s) in a negligent, fraudulent, or illegal manner; and (ii) claims by third parties in any manner related to your purchase or use of the Services and Product(s).

TERMINATION

We reserve the unconditional right to suspend, withdraw, terminate, amend or restrict access to the Sites and Services, in whole or in part, to you at any time immediately and without notice for any reason, and without liability to you, including (without limitation) if: (a) we have reasonable grounds to suspect unauthorized or fraudulent use of the Sites and Services; (b) we reasonably suspect that you have not complied with these Terms and Conditions; or (c) we reasonably suspect a breach of confidentiality or infringement of our intellectual property rights by you or a third party. In the event that we terminate for any of the aforementioned reasons you will not be entitled to future membership or use of the Sites, regardless of whether such use is personal or as a guest or beneficiary of another member.

You may terminate the Services immediately if: (a) we have told you about an upcoming material change to the Sites, Services or these Terms and Conditions and you notify us in writing that you do not agree with such change prior to such change coming into effect; (b) there is a risk that supply of the Services may be significantly delayed because of events outside our control; or (c) we have suspended supply of the Services for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 6 months.

On termination of these Terms and Conditions (for whatever reason) all licenses and rights granted to you in relation to the Sites and Services shall immediately come to an end.

SERVICES AND PRODUCTS PURCHASED FROM THIRD PARTY WEBSITE

We may make certain services available to you through links to third party website. Before you purchase any goods and services through any such third party website, we urge you to carefully review any such third party's privacy, security, return and guarantee policies. Your correspondence or business dealings with any such third party, including payment for and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that When You Fast shall not be responsible or liable for any loss, claim or damages of any sort incurred as a result of any dealings with any such third party.

THIRD-PARTY WEBSITE

We may provide links to other websites that may be of interest to you. We do not monitor or investigate such websites and we are not responsible for the content, functionality or practices of such website. Once you link to a third party website, you will be subject to the terms of use, privacy policy and/or editorial policy of that site. Your linking to such website is at your own risk, and When You Fast is not responsible or liable, directly or indirectly, for any damages or loss caused or alleged to be caused by or in connection with your use of or reliance on any content, goods or services available on or through any such site.

MISCELLANEOUS

(a) These Terms and Conditions contain the final and entire agreement between us regarding your use of the Site and Products and supersedes all previous and contemporaneous oral or written agreements regarding your use of the Site.

(b) These Terms and Conditions are personal to you, which means that you may not assign your rights or obligations under these Terms and Conditions to anyone. Only you and When You Fast shall be entitled to enforce these Terms and Conditions. No third party shall be entitled to enforce any of these Terms and Conditions.

(c) You agree that any cause of action you may have with respect to the Sites must be commenced within one (1) year after the claim or cause of action arises, notwithstanding any statutes of limitation to the contrary. Any failure by When You Fast to enforce or exercise any provision of the Terms and Conditions or related right shall not constitute a waiver of that right or provision.

(d) You agree that any and all disputes will be resolved individually, without resort to any form of class action.

(e) You agree that any and all claims, judgments, and awards will be limited to the actual out-of-pocket amount paid by you to When You Fast, but in no event attorneys’ fees.

(f) You agree that all disputes, claims, causes of action, or controversies of any kind arising out of or in connection to the use of the Sites and the services and all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of purchasers and Company in connection with these Terms and Conditions, will be governed by and construed in accordance with the laws of the State of Pennsylvania, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Pennsylvania or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Pennsylvania.

(g) If any of these Terms and Conditions are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining Terms and Conditions, and will not affect the validity and enforceability of the remaining provisions.

(h) The terms of this section survive any termination of the Terms and Conditions.
